[13 December 1852]

The decree adopting the metric system in Portugal, to take effect in steps over a ten-year period. See also the decree making use of the meter compulsory.

Tomando em consideração o relatorio dos Ministros e Secretarios de Estado de todas as Repartições, e ouvindo o Conselho geral do Commercio, Agricultura e Manufacturas, com o parecer do qual Fui servida conformar-me: Hei por bem decretar o seguinte:

Artigo 1.º É adoptado o metro legal de França como base do systema legal de pesos e medidas no continente do reino e ilhas adjacentes.

Art. 2.º É igualmente adoptada a nomenclatura do systema metrico decimal, para designar as diversas unidades dos novos pesos é medidas seus multiplos e sub-multiplos.

Art. 3.º O novo systema de pesos e medidas deverá estar em pleno vigor dez annos depois da publicação d'este decreto.

Art. 4.º Dentro do praso marcado no artigo antecedente, o Governo fixará successivamente as épocas em que será obrigatorio o uso dos novos pesos e medidas, assim nas Repartições do Estado e estabelecimentos publicos, como entre particulares.
§ 1.º Esta época só poderá ser fixada para seis mezes depois de haverem sido distribuidos os padrões e publicadas as taboas explicativas de que tractam os art. 5.º e 6.° d'este decreto.
§ 2.º O governo poderá fazer executar por partes, em todo o reino e ilhas adjacentes, o novo systema de pesos e medidas, começando pelas unidades, cuja adopção menos diffículdade offereça, com tanto que o systema completo se ache em vigor no praso que marca o art. 3.º

Art. 5.º O governo mandará confeccionar os padrões dos novos pesos e medidas e os fará distribuir por todas as camaras municípaes, pagando estas a importancia do custo dos padrões que receberem.

Art. 6.º Regulamentos de administração publica estabelecerão o processo para a confecção das taboas expositivas, a fórma e a materia dos diversos pesos e medidas, e o methodo, e as regras para o afferimento d'elles.

Art. 7.º Chegada a época em que deve começar a vigorar o novo systema de pesos e medidas, só d'estes será licito usar, quaesquer outros são declarados illegaes.
§ unico. A fabricação e introducção ou venda de pesos e medidas illegaes, será punida com a mulcta de 10 a 100$000 réis, e 10 a 50 dias de prisão, conforme a gravidade das circumstancias. O uso das referidas medidas, será punido com mulcta de 2 a 20$000 réis, e 3 a 15 dias de prisão. Em ambos os casos, serão aprehendidos os pesos e medidas illegaes.

Art. 8.º Da mesma época em diante os fóros, pensões, encargos e contribuições publicas, ainda que estabelecidas por lei ou contracto anterior, serão pagas pelos novos pesos e medidas, feita a reducção do velho ao novo padrão.

Art. 9.º Em todos os contractos e actos publicos celebrados depois da época, qué fôr fixada em conformidade com o disposto no art. 4.º, até aquella em que o systema metrico deve ter plena execução segundo o art. 3.º, será designada a correspendencia entre os novos pesos e os antígos.

Art. 10.º Todo o tabellião ou official publico, que lavrar escriptura ou acto em contravenção com o disposto no art. antecedent e, incorrerá pela primeira vez na mulcta de 50 a 100$000 réis, e pela segunda no dobro e mais no perdimento do officio que servir.

Art. 11.º Nenhum papel ou documento, seja qualquer que fôr a sua natureza, relativo a transacções posteriores á época marcada em conformídade do art. 4.º, poderá ser produzido ou fazer prova em juizo, se os pesos e medidas n'elle designados não forem os estabelecidos por este decreto ou a elles se não referirem.
§ unico. O documento ou papel a que faltarem estes requesitos póde ser revalidado uma vez que a reducção de pesos e medidas illegaés, depois de feita ou mandada fazer pelo apresentante, seja legalisada na administração do respectivo concelho e mediante o pagamento na recebedoria do mesmo concelho de 5$000 réis por cada documento.

Art. 12.º Tanto as penas pecunarias como as de prisão cominadas pelo presente decreto serão julgadas correcionalmente.

Art. 13.º É creada junto ao ministerío das obras publicas, commercio e industrla, uma commissão que será denominada Çommissão Central de Pesos e Medidas, presidida pelo ministro respectivo, e composta de dois vogaes do conselho geral de Obras Publicas e de um vogal de cada uma das secções do Conselho Geral do Commercio, Agricultura e Manufacturãs.
§ unico. A commissão elegerá d'entre os seus membros, Vice-presidente e Secretario.

Art. 14.º A Commissão Central de Pesos e Medidas só exerce attribuições consultivas; mas será necessáriamente ouvida sobre quaesquer providencias que digam respeito ao systema dos novos pesos e medidas; e assim compete-lhe:
1.º Consultar o Governo sobre as propostas de Lei, regulamentos, instrucções e providencias necessarias para execução do presente decreto.
2.º Coordenar taboas expositivas da relação dos novos pesos e medidas com os antigos padrões.
3.º Vigiar e superintender a fabricação dos padrões dos novos pesos e medidas.
4.º Apresentar ao Governo no principio de cada anno um relatorio ou conta dos seus trabalhos no anno anterior.
§ unico. O Relatorio annual da Commissão, será enviado ás Côrtes.

Art. 15.º Fica revogada toda a legislação em contrario.

Art. 16.º 0 Governo dará conta ás Côrtes das disposições contidas n'este decreto. Os Ministros e Secretarios de estado de todas as Repartições, assim o tenham entendido e façam executar.

Translation

Taking into consideration the report of the government Ministers and Secretaries of all departments, and listening to the General Council of Commerce, Agriculture and Manufactures, whose opinion I am conforming to: I have for the common good decreed the following:

Article 1. The legal meter of France is hereby adopted as the legal basis of the system of weights and measures in the continental kingdom and adjacent islands.

Article 2. The nomenclature of the decimal Metric System is also adopted, to designate the various units of the new weights and measures and their multiples and submultiples.

Article 3. The new system of weights and measures shall be in full force ten years after the publication of this decree.

Article 4. Within the period stated in the preceding article, the Government shall successively establish dates when the use of new weights and measures will be obligatory for government departments and public establishments, as well as private individuals.
§ 1. This date can only be fixed six months after explanatory tables have been published and standards distributed, in accordance with articles 5 and 6 of this decree.
§ 2. The government may establish the new system of weights and measures throughout the kingdom and adjacent islands in parts, beginning with units whose adoption offers less difficulty, provided that the complete system is in force within the term specified in article 3.

Article 5. The government shall order the making of standards of the new weights and measures and will distribute them to all Municipal Chambers, who will pay the amount of the costs of standards they receive.

Article 6. Regulations of public administration will establish the process for making the explanatory tables, the shape and composition of the various weights and measures, and method, and the rules for verifying them.

Article 7. Once the term of the new system of weights and measures begins, only these may be lawfully used; any others are declared illegal.
§ Item. The production, distribution and sale of illegal weights and measures shall be punished with a fine of 10,000 to 100,000 reis, and 10 to 50 days in jail, according to the severity of circumstances. The use of such measures shall be punished with a fine of 2,000 to 20,000 reis, and 3 to 15 days in jail. In both cases, the illegal weights and measures shall be seized.

Article 8. From that time onward the fees, pensions, taxes and public contributions, though established by law or previous contract, will be paid by the new weights and measures, converting the old to the new standard.

Article 9. In all contracts and public documents concluded after the times set in accordance with the provisions of article 4 and until such time as the metric system shall be fully implemented according to article 3, the equivalence between the old and new weights shall be given.

Article 10. All notaries or public officials that draw up documents or deeds contrary to the provisions of the preceding articles, shall incur for the first offense a fine of 50,000 to 100,000 reis, and for the second offense the fine is doubled and moreover the office they hold is forfeited.

Article 11. No paper or document, whatever its nature, made subsequent to a date specified in accordance with article 4, may be produced as evidence in court, if the weights and measures used thereon are not those established by this decree or do not refer to them.
§ Item. A document or paper that lacks these requirements could be revalidated, once the conversion of the illegal weights and measures has been done or ordered to be done by the petitioner, and legalized in the administration of the respective council and upon payment to the collector of the same council 5,000 reis for each document.

Article 12. Both penalties, jail or monetary fines, providded for in this decree shall be correctly decided by a court of justice.

Article 13. Under the Ministry of Public Works, Commerce and Industry, a commission shall be created which will be called the Central Commission on Weights and Measures, chaired by the Minister concerned, and composed of two voting members from the general Council of Public Works, and a voting member from each section of the General Council of Commerce, Agriculture and Manufactures.
§ Item. The commission shall elect from among its members a Vice President and Secretary.

Article 14. The Central Commission on Weights and Measures acts only in an advisory capacity, but is necessarily heard about any provisions relating to the system of new weights and measures, and thus is responsible for:
1. Shall consult with the Government on draft laws, regulations, instructions and necessary measures towards implementation of this decree.
2. Shall coordinate explanatory tables to convey the relationship of the new weights and measures to the old standards.
3. Shall oversee and supervise the manufacture of new standards of weights and measures.
4. Shall submit to the Government at the beginning of each year a report or account of their work in the preceding year.
§ Item. The Annual Report from the Commission will be sent to the Court.

Article 15. All previous legislation contrary to this decree is hereby repealed.

Article 16. The Government will advise the Court of the provisions contained in this decree. The Ministers and Secretaries in all departments have understood the matter thus and will act to carry it out.
